郭台铭：微软诈取不当专利保护费 富士康无侵权

3月12日，富士康科技集团(又名鸿海精密)董事长郭台铭通过社交网络宣布，今天凌晨收到微软起诉书。郭台铭还表示，今天是其前妻仙逝14周年忌日，将在祭拜后，11时30分在鸿海土城总部召开临时记者会，报告说明“微软的霸道”。

郭台铭在社交网络上称，微软状告显然心虚，在富士康收到起诉书之前，抢先在媒体发布新闻，意在敲山震虎，诈取不当专利保护费，而不专注在法律诉讼的内容。微软的目的是向华为索取使用Android的专利保护费，而富士康本身不做诉讼内Android产品，“故绝不会有侵权事项”。

富士康方面向记者证实了上述社交网络内容属实。

近日，微软向美国加州北区地方法院提交诉状，指控富士康未能就某些未指明的产品提供每年两次的专利授权报告，而且没有按时支付专利使用费。微软要求富士康支付专利费以及相应利息，以及审查富士康账簿和咨询律师所产生的费用。

目前尚不清楚微软与富士康的协议涵盖哪些产品，但微软在2013年曾表示，该公司与富士康达成安卓和Chrome OS设备的专利协议。该协议的副本已提交法院，但仍处于密封状态。

外媒报道称，微软发言人回应，微软认真对待自己的合同承诺，我们希望其他公司也这样做。这一法律行动只是为了履行我们在2013年与富士康签署的一份合同的报告和审计条款。我们与富士康的合作关系非常重要，我们正在努力解决我们之间的分歧。

不过，截至发稿时，微软中国方面尚未对此事做出回应。
